Start with the Business Activity
The appropriate arrangement depends on what the firm does. Commercial property acquisitions and dispositions, leasing, property management, debt advisory assignments, and business transfers involving real estate can raise different brokerage requirements.
The review should address the proposed activities, transaction or property locations, participating entities, and compensation arrangements. A firm’s headquarters alone does not determine its brokerage needs.
Define Responsibilities Before Work Begins
An engagement should establish the covered states and activities, supervisory responsibilities, required disclosures, document review, recordkeeping, and fees.
Branding also requires attention. A firm may retain its client-facing identity while identifying the licensed brokerage as required by applicable rules.
Coordinate Oversight as the Business Expands
A direct relationship provides one point of coordination for covered engagements. Additional states, entities, or services should be reviewed as the firm’s activities change.
The purpose is to support expansion with defined responsibilities and consistent brokerage oversight.
